DMCA Policy

SmartCodePath respects the intellectual property rights of others and expects users of the website to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have established the following policy for responding to claims of copyright infringement.

Copyright Infringement Notification

If you believe that your work has been copied and is accessible on the SmartCodePath website in a way that constitutes copyright infringement, you may submit a notice of infringement to our designated copyright agent. The notice must include the following information:

Once we receive your DMCA notice, we will take appropriate action, which may include removing the infringing content or disabling access to it.

Counter-Notification

If you believe that your content has been removed or disabled due to a mistake or misidentification, you may file a counter-notification. The counter-notification must include the following:

  1. Identification of the material: A description of the material that was removed or to which access was disabled and the location of the material before it was removed or disabled.
  2. Contact information: Your name, address, telephone number, and email address.
  3. Statement of good faith: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled due to mistake or misidentification.
  4. Statement of consent: A statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located, or if you are outside the United States, for any judicial district in which SmartCodePath may be found.
  5. Signature: A physical or electronic signature of the person authorized to act on behalf of the owner of the material.

After we receive a valid counter-notification, we may restore the content unless the original copyright claimant files a lawsuit within 10 business days.

Repeat Infringers

In accordance with the DMCA, SmartCodePath has a policy of terminating the accounts of users who are repeat infringers. If you are a repeat infringer, we may permanently block your access to the website.
